In Kentucky there is a presumption (rebuttable by a preponderance of evidence) that parents should share joint custody and equal parenting time. Legal custody refers to the ability of a parent to make decisions regarding the child’s education, healthcare, religion, and other important major life decisions.
Kentucky family courts adhere to Kentucky Revised Statue (KRS) 403.270 which provides factors that Courts must apply to determine custody in accordance with the best interests of the child.
